EUDR Compliance for Businesses Sourcing from Malaysia
Overview
If your business places palm oil, rubber or wood products – or goods containing them – on the EU market, the EU Deforestation Regulation (EUDR) now makes you responsible for proving where they came from. Article 3 requires you to establish that the product is both deforestation-free and produced in accordance with the law of the country of production. For Malaysian-origin goods, that means Malaysian land use, forestry, labour and tax law – not a standard your EU compliance team can assess from Brussels.
What Article 3 of the EUDR actually asks of you
- 01
A risk assessment covering the specific plot of production, not just the country of origin
- 02
Plot-level geolocation data for each consignment
- 03
Evidence of legality under Malaysian law – land rights, forestry permits, labour compliance, Free, Prior and Informed Consent where indigenous land is involved, and tax
- 04
A Due Diligence Statement filed before the product enters the EU market
Large and medium operators must comply from 30 December 2026; micro and small operators from 30 June 2027. The European Commission has made it clear that there will not be any further delays – this is a hard deadline.
Certification helps, but it doesn’t replace your own due diligence
Malaysia’s MSPO certification and the national traceability infrastructure behind it (e-MSPO, GeoSawit, SIMS), strengthen a Malaysian supplier’s position. But certification, as the EUDR itself makes clear, is not a substitute for your own due diligence obligation – you still need the geolocation data, the legality evidence and a Due Diligence Statement you can stand behind if it’s challenged. Relying on a certificate alone is one of the more common EUDR mistakes we see.
Where the EUDR bites by sector in Malaysia
Palm oil and palm-derived ingredients
Rubber and rubber products – natural rubber, latex, tyres, conveyor belts, medical and industrial gloves
Timber, plywood, furniture and pulp/paper
Most buyers get the contract wrong
A supplier who is EUDR-compliant today is not, by itself, a protection for you. That protection has to be written into the supply contract. This includes:
- a warranty that the goods are deforestation-free and legally produced
- a contractual obligation to supply geolocation and legality documentation on demand
- audit rights to verify it
- a clear allocation of liability if the supplier’s data turns out to be wrong.
- without an arbitration clause, none of it is practically enforceable against a Malaysian counterparty – a judgment from most EU courts is not straightforwardly recognised or enforced in Malaysia (if at all!), and litigating locally without pre-agreed dispute resolution is slow and uncertain.
Full treatment of supply chain contract terms
See our full treatment of supply chain contract terms for the broader drafting approach; the points above are the ones EUDR specifically puts under pressure.
Why work with us on this
We work both sides of this regulation: advising EU businesses on their Article 3 exposure and working directly with Malaysian producers and exporters on the compliance file itself – including training members of the Federation of Malaysian Manufacturers and the Malaysian Rubber Glove Manufacturers’ Association on EUDR compliance and speaking on the regulation in Austria, Germany, Malaysia and Japan. That means we can tell you not just what the regulation requires, but what is realistically achievable from a Malaysian supplier and where to push back.
